Legally speaking, can I ever get a job ?

I’ll try to make this short as possible.

In 2000 I was the webmaster for a *** website. I had lived in the area for 53 years and owned a motorcycle shop there for 23 yrs. Over the years the police came to me and told me things and I learned from my m/c customers about a mayor that gets $350K under the table found that the FBI was involved in illegal cover ups too. All was good until 2001 when the police appeared at my door to take my computer.
Long story short, the District Attorney wanted to discredit me to protect their friends and themselves so they charged me with 5 felonies and added a sexual registration requirement to it. I refused to plead guilty so they told my attorney that they had been doing this for a long time and they could do things that would get me into prison and I would be murdered if I did not at least plead nolo contendere to 3 felonies, otherwise they would bump it up to 80 felonies, most assuredly get a conviction on at least 1, spread a rumor, prison inmates would murder me. My attorney said that I should not plead guilty BUT that a wise man would weigh his options and plead accordingly. He said that if I plead NC that at least I would be alive and could move to another county and start over. I followed his advice. And yes, he was a P.D.
My problem is that with these felonies and a sexual registration requirment, I cannot get a job anywhere. I had three that wanted to hire me this month but when the background check arrived they suddenly had no job available.
My probation officer told me that I could file and Withdraw My Plea. I have the section numbers somewhere and can pull those out if that would help but there were also 2 other things to file along with that and he said that would expunge the felonies and sexual reg. from my record.
I know of a Legal Aid lawyer locally who could probably file these things for me at a reduced rate. But since this happened in another county in California, would I have to go BACK to that county, (fair trial would be impossible there), or can I have it heard here in Southern California?
Basically, I want to work and need to do whatever is necessary to be able to do so.
HELP!

PS … there was a guy who was jailed for similar stuff the next month after I left and he died in jail, so I believe the DA was serious about the threat and my many years of being a local business owner allowed me the privilege of leaving with my life. Many other people in that area are swimming with the fishes. I can tell you the actual area in a private email, but won’t divulge it publicly F.O.R.

N.B. Even though the *** website only listed local *** baseball and volleyball schedules and locations, local events, and national *** news, the DA added the sexual registration requirement b/c they claimed: The only reason to operate a *** website is to lure people in for sexual exploitation.

There was never a trial and no one was actually injured. When I told the DA that our Hotline actually saved 7 people from ******* they said WHY? IF they’re *** they will go thru hell ALL of their lives and would be better off dead. Just LET THEM DIE! (((This area was and still is very homophobic))).

    Hi Dart,

I have read your note. In it you offered to provide more details in an email. You might have considered that for more of the body and try to hit a few highlights only in the primary question.

I have 2 other things to point out. 1st of all you mentioned a public defender was your first attorney. Yes, it is hard to have confidence there. You mentioned legal aid as a possible avenue for assistance. You could also consider what *** activist organizations are in your area or the nearest metropolitan area. They may wish to make an issue of your case. The same might be true of the ACLU.

Alternatively, in most areas attorneys are expected to do a certain amount of pro bono work. You might have to go door to door at attorney’s offices to find someone like this. Contacts will help. If you qualify in their eyes they might represent you without cost. This is particularly true if there are other incentives such as defending a cause they believe in or has a certain notoriety.

Secondly, if the facts of your situation are born out you might appeal to the US attorney general in your area. Issues of corruption are difficult to deal with in the local area. One thing that this accomplishes is to take matters to the federal level and away from local courts. Another way to accomplish the same thing is to ask the courts for a change of venue (location) for any trial and pleadings. Consider that your probation officer is a part of the local system.

Your main job is to get someone to acually listen to you. You are fighting for something. You need to find someone who is fighting for the same thing or who whats to help you. Why?

Of course the entirely different approach is to start over. There are different levels of this … a different country, harder to do without savings… a different state or county, easier to do but you may have problems with probation, or under the radar, this is rather drastic. To be effective it means severing all ties with family, existing friends and past history. To accomplish this, questions of legality may also arise other than probation issues.

Finally, there is the possibility of approaching employment from the level of person to person rather than person to company. A company will look at the numbers. They are required to for reasons of liability bla bla bla… A person might give you a break, especially if you can explain the circumstances convincingly in a way that either exhonorates you or gives you a pass in another way. This may mean accepting work other than your first choice and possibly a lower pay scale. Family or friends might be a place to start.
